These Terms of Use ("Terms") are an agreement between you and Hupe Games ("we", "us") about the Tinyscape game (the "App") and this website. By downloading or using the App, you accept these Terms. If you do not accept them, do not use the App.
1. License
We give you a personal, non-exclusive, non-transferable, revocable license to download and use the App on devices that you own or control. The license is for personal, non-commercial entertainment and follows the usage rules of the store where you got the App. We license the App to you. We do not sell it to you.
2. What you may not do
- Copy, sell, rent, lend or redistribute the App or its parts.
- Reverse engineer, decompile or disassemble the App, except where the law allows this.
- Remove or change any copyright or trademark notice.
- Use the App or its content to break any law.
3. Your creations and screenshots
The worlds you build are saved on your device and belong to you as creative works. You may share screenshots and videos of the App, including on streams and social media, and you may earn money from your videos. Please do not suggest that we endorse you. The game assets themselves (art, models, music, code) remain our property.
4. Intellectual property
The App, the Tinyscape name and logo, the Hupe Games name and logo and all related content belong to Hupe Games or its licensors. Third-party components are used under their own licenses.
5. Purchases and refunds
You buy the App and any in-app content through the Apple App Store or Google Play. Their terms apply to payment, billing and refunds. See our Refund Policy.
6. Updates and availability
We may update the App to fix bugs, improve performance or add content. Some updates can be necessary to keep using the App. We try to keep your saves compatible, but we cannot guarantee this for every future version. We may stop selling or supporting the App at any time.
7. Disclaimer
We provide the App "as is" and "as available". To the maximum extent that the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the App is free of errors or that it works on every device.
8. Limitation of liability
To the maximum extent that the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, that come from your use of the App. Our total liability is limited to the amount you paid for the App. Nothing in these Terms limits liability that the law does not allow us to limit, or your mandatory consumer rights.
9. Apple App Store terms
If you got the App from the Apple App Store, these additional terms apply:
- These Terms are between you and Hupe Games only, not with Apple. Hupe Games, not Apple, is responsible for the App and its content.
- Your license is limited to use on Apple-branded products that you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions allow.
- Apple has no obligation to give maintenance or support for the App.
- If the App does not conform to an applicable warranty, you can notify Apple, and Apple will refund the purchase price, if any. To the maximum extent that the law allows, Apple has no other warranty obligation for the App.
- Hupe Games, not Apple, is responsible for any claims about the App, including product liability claims, claims that the App does not meet a legal or regulatory requirement, and consumer protection or privacy claims.
- If a third party claims that the App infringes its intellectual property rights, Hupe Games, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
- You confirm that you are not in a country under a U.S. Government embargo or listed as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple has the right to enforce them against you.
Where these Terms do not cover a topic, the Apple Standard EULA applies.
10. Google Play terms
If you got the App from Google Play, the Google Play Terms of Service also apply. Google is not responsible for the App.
11. Governing law
The laws of the Republic of Türkiye govern these Terms. The courts and enforcement offices of Türkiye have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can go to the consumer courts there.
12. Changes and contact
We may change these Terms. We will publish the new version on this page with a new date. If you continue to use the App after a change, you accept the new Terms. Questions: support@hupegames.com.
Bu Kullanım Koşulları ("Koşullar"), Tinyscape oyunu ("Uygulama") ve bu web sitesi hakkında seninle Hupe Games ("biz") arasındaki sözleşmedir. Uygulamayı indirerek veya kullanarak bu Koşulları kabul etmiş olursun. Kabul etmiyorsan Uygulamayı kullanma.
1. Lisans
Sana, Uygulamayı sahip olduğun veya kontrol ettiğin cihazlarda indirip kullanman için kişisel, münhasır olmayan, devredilemez ve geri alınabilir bir lisans veriyoruz. Lisans kişisel ve ticari olmayan eğlence içindir ve Uygulamayı edindiğin mağazanın kullanım kurallarına tabidir. Uygulamayı sana satmıyor, lisanslıyoruz.
2. Yapamayacakların
- Uygulamayı veya parçalarını kopyalamak, satmak, kiralamak, ödünç vermek veya yeniden dağıtmak.
- Kanunun izin verdiği durumlar dışında Uygulamayı tersine mühendislikle incelemek, kaynak koda dönüştürmek veya parçalara ayırmak.
- Telif hakkı veya marka bildirimlerini kaldırmak ya da değiştirmek.
- Uygulamayı veya içeriğini hukuka aykırı amaçlarla kullanmak.
3. Yaptıkların ve ekran görüntüleri
İnşa ettiğin dünyalar cihazında saklanır ve yaratıcı eser olarak sana aittir. Uygulamanın ekran görüntülerini ve videolarını yayınlarda ve sosyal medyada paylaşabilir, videolarından gelir elde edebilirsin. Lütfen bizim tarafımızdan desteklendiğin izlenimini verme. Oyunun kendi içerikleri (çizimler, modeller, müzik, kod) bize ait kalır.
4. Fikri mülkiyet
Uygulama, Tinyscape adı ve logosu, Hupe Games adı ve logosu ve ilgili tüm içerikler Hupe Games'e veya lisans verenlerine aittir. Üçüncü taraf bileşenler kendi lisanslarına göre kullanılır.
5. Satın almalar ve iadeler
Uygulamayı ve varsa uygulama içi içerikleri Apple App Store veya Google Play üzerinden satın alırsın. Ödeme, faturalama ve iadeler bu mağazaların koşullarına tabidir. İade Politikası'na bakabilirsin.
6. Güncellemeler ve erişilebilirlik
Hataları düzeltmek, performansı artırmak veya içerik eklemek için Uygulamayı güncelleyebiliriz. Uygulamayı kullanmaya devam etmek için bazı güncellemeler gerekebilir. Kayıtlarını uyumlu tutmaya çalışırız, ancak gelecekteki her sürüm için bunu garanti edemeyiz. Uygulamanın satışını veya desteğini istediğimiz zaman durdurabiliriz.
7. Sorumluluk reddi
Uygulama "olduğu gibi" ve "mevcut olduğu şekilde" sunulur. Kanunun izin verdiği en geniş ölçüde, belirli bir amaca uygunluk ve hak ihlali olmaması dâhil açık veya örtülü tüm garantileri reddederiz. Uygulamanın hatasız olduğunu veya her cihazda çalıştığını garanti etmeyiz.
8. Sorumluluğun sınırlandırılması
Kanunun izin verdiği en geniş ölçüde, Uygulamanın kullanımından doğan dolaylı, arızi, özel veya sonuç niteliğindeki zararlardan ya da veri kaybından sorumlu değiliz. Toplam sorumluluğumuz Uygulama için ödediğin tutarla sınırlıdır. Bu Koşullardaki hiçbir hüküm, kanunen sınırlanamayan sorumluluğu veya emredici tüketici haklarını sınırlamaz.
9. Apple App Store koşulları
Uygulamayı Apple App Store'dan edindiysen şu ek koşullar geçerlidir:
- Bu Koşullar Apple ile değil, yalnızca seninle Hupe Games arasındadır. Uygulamadan ve içeriğinden Apple değil Hupe Games sorumludur.
- Lisansın, Apple Medya Hizmetleri Hüküm ve Koşulları'ndaki Kullanım Kuralları çerçevesinde, sahip olduğun veya kontrol ettiğin Apple markalı ürünlerde kullanımla sınırlıdır.
- Apple'ın Uygulama için bakım veya destek sağlama yükümlülüğü yoktur.
- Uygulama geçerli bir garantiye uymazsa Apple'a bildirebilirsin. Apple, varsa satın alma bedelini iade eder. Kanunun izin verdiği en geniş ölçüde Apple'ın Uygulamaya ilişkin başka bir garanti yükümlülüğü yoktur.
- Ürün sorumluluğu, yasal veya düzenleyici gerekliliklere uyulmadığı iddiaları ve tüketici koruma veya gizlilik talepleri dâhil Uygulamayla ilgili tüm taleplerden Apple değil Hupe Games sorumludur.
- Üçüncü bir taraf, Uygulamanın fikri mülkiyet haklarını ihlal ettiğini iddia ederse, bu iddianın incelenmesi, savunulması ve sonuçlandırılmasından Apple değil Hupe Games sorumludur.
- ABD Hükümeti ambargosu altındaki veya "teröre destek veren" olarak listelenen bir ülkede bulunmadığını ve ABD Hükümeti'nin yasaklı veya kısıtlı taraflar listesinde yer almadığını beyan edersin.
- Apple ve bağlı şirketleri bu Koşulların üçüncü taraf lehtarlarıdır. Koşulları kabul ettiğinde Apple bunları sana karşı uygulama hakkına sahip olur.
Bu Koşulların düzenlemediği konularda Apple Standart Son Kullanıcı Lisans Sözleşmesi geçerlidir.
10. Google Play koşulları
Uygulamayı Google Play'den edindiysen Google Play Hizmet Şartları da geçerlidir. Google, Uygulamadan sorumlu değildir.
11. Uygulanacak hukuk
Bu Koşullara Türkiye Cumhuriyeti kanunları uygulanır ve Türkiye mahkemeleri ile icra daireleri yetkilidir. Tüketiciysen, 6502 sayılı Tüketicinin Korunması Hakkında Kanun dâhil, yaşadığın ülkenin emredici kanunlarının sağladığı korumadan ve tüketici hakem heyetleri ile tüketici mahkemelerine başvurma hakkından yararlanmaya devam edersin.
12. Değişiklikler ve iletişim
Bu Koşulları değiştirebiliriz. Yeni sürümü yeni tarihle bu sayfada yayınlarız. Değişiklikten sonra Uygulamayı kullanmaya devam edersen yeni Koşulları kabul etmiş olursun. Sorular için: support@hupegames.com.
